Terms of Use – Pave App

The Cancer Institute NSW (the Institute), which is an agency within the NSW Government, operates the Pave app (App). 

Operation of these Terms of Use

When you download and register for the App, you agree to follow these Terms of Use (“Terms”). These Terms form a legally binding agreement between you and the Institute.

These Terms cover:

  • Who can register
  • Submitting and updating your registration information
  • How to cancel your registration
  • What kind of content is allowed
  • How to report or remove content
  • Who owns the content you submit
  • How we use the content you submit
  • Limits to our responsibility
  • Your privacy

If you don’t follow these Terms, your account could be suspended or closed.

Eligibility for Registration

If you are under 16 years old, you should have your parent or legal guardian’s consent to register for the App. The Institute is not liable for any costs or liabilities incurred by a parent or legal guardian in connection with your registration.

Acceptable Content

While using the App, you may input text (such as for goal-setting purposes). You must not upload any content that is discriminatory, offensive, violent, defamatory, obscene, or otherwise inappropriate. This includes but is not limited to content that:

  • Is discriminatory, racist, hateful, violent, threatening, abusive, defamatory, disparaging, obscene, vulgar, feature nudity or is pornographic, profane or indecent or are otherwise unlawful;
  • Infringe any other person's copyright, moral rights or other intellectual property rights;
  • Promotes products, services, external websites or apps;
  • Encourages or promotes vaping, tobacco or nicotine use.

The Institute reserves the right to remove any content that breaches these Terms, at its sole discretion.

Acceptance of Registration Form and Entries

After submitting your registration, in most cases, you will be registered immediately, and you will be able to use the App’s features.

Amendment of Registration Information and Materials

You can delete your registration information at any time through your settings in the App. If you need to correct or update incorrect information, you may contact prevention@cancer.nsw.gov.au.

Complaints and Requests to Remove Content

If you believe any content breaches these Terms, you may submit a complaint to prevention@cancer.nsw.gov.au. The Institute reviews such reports during regular business hours (excluding weekends and public holidays), and content will be reviewed on the next business day if reported outside of these hours.

Representations and Warranties

By registering for and using the App, you confirm that:

  • All information in your registration form is true and correct at the time of submission.
  • The content you submit, including text and images, is your original work and does not infringe on anyone else’s rights.
  • Your content does not contain harmful software or code.
  • Your content does not defame, misrepresent, contain disparaging remarks or other content that could adversely affect the name, reputation or goodwill of anyone or contain pornographic or hateful content that promotes violence or harm or other offensive, obscene or inappropriate content or contravene any other law;
  • You agree to indemnify the Institute for any losses, liabilities, or legal claims arising from your use of the App or a breach of these Terms.

Copyright Ownership and Consents

You retain ownership of any content you submit to the App. However, by submitting this content, you grant the Institute a licence to anonymously use, reproduce, and/or display the content within the app and/or promotional materials.

License to Use Submitted Materials

By submitting content, you grant the Institute an irrevocable, perpetual, royalty-free license to use your content for the operation of the App. This may include reproduction of your content within the App and for non-commercial government use, including on platforms like Facebook and Instagram.

Exclusions and Limitations of Liability

Except for liability that cannot be excluded by law, the Institute and its officers, employees, and agents exclude all liability for any injury, loss, or damage, including direct, indirect, or consequential loss, arising from the use of the App. This includes but is not limited to:

  • Technical difficulties or equipment failure
  • Unauthorised access or third-party interference
  • Late, lost, or misdirected content due to circumstances beyond the Institute’s control
  • Registration Cancellation and Removal of Material
  • Your registration may be cancelled if you fail to complete all mandatory details in the registration process or do not comply with these Terms. If the App’s operation is compromised, the Institute may cancel or modify the App at any time.

Rejection and Removal of Material

The Institute reserves the right, for any reason or no reason to:

  • refuse to upload or remove any content submitted through the App; and
  • suspend or terminate your registration and your access to the App.

Giving effect to these Terms

Any use by you of the App is subject to these Terms and such use evidences your full acceptance of these Terms without anything further required.

Governing Law

These Terms and your use of the App are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

Privacy

By registering and using the App, you agree to the collection, use, and disclosure of your information as set out in the App’s Privacy Statement. Please review this policy before completing your registration.
